Iowa Nursing Home Gets A Retrial For Resident Death

(Buffalo, IA) -- A nursing home in Scott County is getting a new trial over a resident's death.

The Timely Mission Nursing Home in Buffalo faced a $6 million jury verdict for the death of Darlene Weaver in 2017.

According to court documents, the 2021 verdict is being reversed due to wrongly admitted testimony alleging staff abuse towards other residents.

The Iowa Court of Appeals says much of the evidence included is hearsay and should've been excluded in the trial.

Weaver's family sued the nursing home after she died from injuries she sustained in a fall.
