(Omaha, NE) -- A Nebraska jury has awarded the largest amount the state has seen for a malpractice lawsuit.
The Marousek family was awarded $26M after their eleven month old daughter suffered permanent brain damage from seizures she was being treated for at Children's Hospital and Medical Center in Omaha.
However, the family may only receive $4.5M of the money due to the state's cap on medical malpractice verdicts that an attorney for the Children's Hospital is encouraging to be enforced.
The family claims the child should have never been discharged from the hospital.
The funds are aimed at providing future around the clock care for the child.
